1. Service Agreement
These Terms and Conditions govern the provision of Martin's Law compliance consultancy services by Martin's Law Compliance Support ("we", "us", "our") to educational institutions ("client", "you", "your").
Service Focus: We are the UK's first dedicated consultancy helping educational institutions comply with the Protect Duty (Martin's Law) legislation.
2. Service Packages
Bronze Package (£795)
- Site walkthrough (virtual or in-person)
- Martin's Law compliance checklist
- Custom Emergency Action Plan template
- Staff awareness briefing (1 hour virtual)
Silver Package (£1,850)
- All Bronze package inclusions
- Full risk assessment (physical security + procedures)
- Emergency Drill Log + Action Plan templates
- Bespoke policy bundle (EAP, lockdown, communications)
- Two hours of remote consultancy
Gold Package (£3,250/year)
- All Silver package inclusions
- Annual re-audit and updated documentation
- Digital evidence folder preparation
- Quarterly compliance check-ins (virtual)
- Emergency drill review and staff guidance updates
Platinum Package (from £7,500/year)
- Multi-site central compliance management
- Staff CPD training (up to 40 participants)
- Annual re-audit for each site
- Dedicated consultant advisory service
3. Payment Terms
Standard Terms
- Deposit: 50% upon booking confirmation
- Final Payment: 50% upon final delivery
- Public Sector: 30-day invoice payment window available
- VAT: All prices exclude VAT where applicable
Volume Discounts
- 3-5 sites: 5% discount
- 6-10 sites: 10% discount
- 11+ sites: Custom quotation
4. Service Delivery
Timeline
- Bronze/Silver: 4-6 weeks from booking
- Gold/Platinum: Initial delivery 6-8 weeks
- Annual Reviews: Scheduled annually from start date
Client Responsibilities
- Provide accurate site information and access
- Participate in scheduled consultations
- Implement recommended security measures
- Maintain records as advised
5. Professional Standards
Compliance Assurance
Our services are designed to help clients meet Martin's Law requirements. However:
- Final compliance responsibility remains with the client
- We provide guidance based on current legislation
- Regulatory changes may require service updates
- Implementation of recommendations is client responsibility
Professional Indemnity
We maintain professional indemnity insurance and operate to industry standards for consultancy services.
6. Intellectual Property
Delivered Materials
- Custom Documents: Client owns bespoke materials created for their site
- Templates: Licensed for client use, not for redistribution
- Training Materials: Licensed for internal use only
- Methodologies: Remain our intellectual property
7. Confidentiality
We maintain strict confidentiality regarding:
- Site security information and assessments
- Internal policies and procedures
- Staff information and training records
- Organizational structure and operations
Information is only shared with your consent or where legally required.
8. Limitation of Liability
Important: Our liability is limited to the value of services provided. We are not liable for consequential losses or damages arising from security incidents.
Exclusions
- Damages from failure to implement recommendations
- Losses from regulatory changes post-delivery
- Consequential or indirect damages
- Loss of profits or business interruption
9. Cancellation and Changes
Client Cancellation
- Before work starts: Full refund minus 10% administration fee
- Work in progress: Charges for work completed
- After delivery: No refunds available
Service Changes
- Scope changes may incur additional charges
- Timeline changes subject to availability
- Major changes require new agreement
10. Force Majeure
We are not liable for delays or failures due to circumstances beyond reasonable control, including:
- Natural disasters or extreme weather
- Government restrictions or legislation changes
- Strikes, labor disputes, or supply chain disruptions
- Technology failures or cyber incidents
11. Dispute Resolution
Process
- Direct Discussion: Initial attempt to resolve informally
- Mediation: Independent mediation if needed
- Legal Action: UK courts have exclusive jurisdiction

These terms are governed by the laws of England and Wales.
